The law takes effect July 1, 2015.

The law applies to all staff and faculty of the college including individuals in temporary or otherwise non-benefited positions.

Current Williams students are not eligible to earn or use sick leave during the academic year when working on campus and Federal Work Study jobs. These positions are exempt from the Massachusetts Earned Sick Time Law and Federal Insurance Contributions Act (FICA) withholding.

During non-academic summer months, students are hired as temporary staff employees (Federal Insurance Contributions Act (FICA) is withheld), and therefore may earn and use sick leave.

Sick leave may be used to:
(1) care for the employee’s own physical or mental illness, injury, or medical condition that requires home care, professional medical diagnosis or care, preventive medical care, or the employee’s routine medical appointment;
(2) care for the employee’s child, spouse, parent, or parent of a spouse, who is suffering from a physical or mental illness, injury, or medical condition that requires home care, professional medical diagnosis or care, preventive medical care, or a routine medical appointment;
(3) address the psychological, physical or legal effects of domestic violence as defined under the Domestic Violence Leave Rights policy.Earned sick time includes time necessary to travel to and from an appointment, a pharmacy, or other location related to the purpose for which the time was taken.
If the use of earned sick time is foreseeable, the employee must make a good faith effort to provide notice to the employer in advance of using the earned sick time.

Sick time may be used as soon as it is credited. Hourly (non-exempt) employees may use sick time at a minimum of 15-minute increments. Administrative (exempt) staff may use sick time at a minimum of half-day increments.

For absences longer than 3 consecutive work days, Family Medical Leave Act (FMLA) verification will be initiated.

• Hourly (non-exempt) benefited staff will continue to earn paid sick leave at a rate of one day per month, up to a maximum of 80 days.
• Salaried (exempt) benefited staff will continue to be paid 100% when absent. After 10 days of personal illness, the College's Short-term Disability Policy kicks in to cover full pay.
• (NEW) All temporary and non-benefited staff earn one hour per 30 hours worked up to a maximum of 40 hours of paid sick leave.

An employee who receives different pay rates for hourly work will be paid the same hourly rate they would have been paid if they had worked.

Sick leave is not paid out at the time of separation or under any other circumstance.

If an employee returns after a break in service of less than one year, the employee shall maintain the right to use any accrued earned sick time from the prior service.
